E-2 Visa Basics

What is an E-2 Investor Visa?

E-2 Visa allows citizens of certain countries to work for a US enterprise in which they, or other people from their same country, have made a substantial investment.

If you have funds to invest in a US business enterprise, you may be eligible for an E-2 Visa. The E-2 Visa is an excellent and fast solution to lawfully move and work in the United States for yourself and your family members.

E-2 Visa Key Features:

  • NO MINIMUM INVESTMENT REQUIRED ($80,000 RECOMMENDED)
  • PROCESSING TIME TAKES LESS THAN 3 MONTHS
  • RENEWABLE UNLIMITED TIMES

E-2 Visa Investment

Although there is no minimum investment, E-2 Visa applicants should expect to invest at least $80,000. The funds should be irrevocably put at risk and entirely committed to the business, which means that if your venture fails your investment will not be recovered.

The US enterprise in which you invest should be engaged in active trade of goods or services with the goal of generating profits.  Passive investments, such as the purchase of stocks or real estate properties, do not qualify for the E-2 Visa.

Investing in a US enterprise means starting your own business from scratch or acquire at least 50% of an existing business. A solution in between is buying a franchise activity.

Funds should originate from a legitimate source, typically from other activities of the beneficiary. However, funds may also originate from a loan or a gift.

The business in which you invest should not be marginal, e.g., should secure a living for more than just the beneficiary of the visa and his family.

Investing in a US enterprise means starting your own business from scratch or acquire at least 50% of an existing business. A solution in between is buying a franchise activity.

Purchasing a franchise business is a great opportunity to start a business without knowing much about it in general and without the initial capital required to start from the ground up. In the U.S. there are many types of franchise activities. However, when it comes to a franchise business, there are several objections the Consulate may have. It is preferable to prevent these scenarios by consulting a qualified attorney such as those at E-2VisaWorld.

Eligibility

The E-2 visa is reserved to nationals of countries who maintain certain treaties of commerce with the United States, which is the majority of the countries worldwide (see the list of E-2 Visa countries below). Notable exceptions are Brazil, China, and Russia, but other E-2 visa-related solutions are available.

Investor, key employees, and their respective families are eligible for an E-2 Visa for the United States.

Unlimited Renewals

The E-2 visa may be granted for periods up to 5 years, and it is renewable unlimited times as long as the requirements are in place and the business is operating.

What are the E-2 Visa requirements?

An E-2 Treaty Investor Visa is a work visa reserved for entrepreneurs of certain nations. With this visa, foreign investors, their immediate family members, and employees can travel and work within the U.S. If you decide to file a petition for an E-2 Investor Visa, you have to be aware of the requirements for obtaining it.

Top E-2 Visa requirements include:

  • Nationality of the business: The enterprise should be owned by a national of a Treaty Country
  • Ownership structure: You should own at least 50% of the business
  • Investment type and amount: Investment must be “substantial”

A qualified E2 visa lawyer can help you explore which strategy will best fit your case. At E-2VisaWorld we are ready to guide you through each step of the process.

WHAT IS A QUALIFYING INVESTMENT FOR E-2 VISA?

Top factors examined when determining whether an investment qualifies for an E-2 Visa include:

  • Substantiality: there is no minimum investment amount but it should be sufficient to support your business operations
  • Marginality: the investment should generate profits to support a living not just for the beneficiary
  • Active investment: money should be invested in an “active” U.S. business enterprise
  • Source of funds: funds should have a legitimate origin

However, if you want to purchase an existing US enterprise by placing your funds in escrow, you should be aware of a few things. E-2 Visa guidelines allow for E-2 Visa applications based on escrow funds as long as there is an escrow agreement in place. That agreement has to allow disbursing the money to the seller if the application gets approved. It is vital that the purchase agreement is drafted properly by an attorney to make sure that both buyer and the applicant are protected. Experts at E-2VisaWorld are highly specialized in drafting and reviewing asset purchase agreements.
